Who, Why and How exiled:

Khodzhayev is a practising Muslim, though claims to have no link to Hizb ut Tahrir or any other political party. On the 22nd June 2000, the Ministry of Security of Tajikistan instituted criminal proceedings against Khodzhayev on account of his membership to Hizb ut Tahrir, resulting in him fleeing to Moscow in 2001 (European Court of Human Rights,  2010).

Stage 1 details (accusations/ charges/ Interpol notice/ extradition requests):

Between 27th October and 7th December 2001, Khodzhayev was kept in detention in Russia with a view to his extradition, however he was released because no formal request for his extradition was received. However, the Russian authorities claim that in February 2002, the Tajik Prosecutor General asked that Khodzhayev be extradited to Tajikistan following which the Russian police started searching for him (European Court of Human Rights, 2010).

Stage 2 details (arrest/ detention/ extradition):

On the 28th November 2007, Khodzhayev was arrested in Moscow and questioned on the same day. He faced further questioning on the 30th November, without the presence of a lawyer. Khodzhayev’s extradition was ordered in June 2008 by the Russian prosecuting authorities upon a request by the Tajik Prosecutor General made in December 2007. ECHR ruled that extraditing Mr Khodzhayev to Tajikistan would violate Article 3. On the 3rd November 2008, it was declared by the President of the First Section and Khodzhayev should not be extradited to Tajikistan until further notice (European Court of Human Rights,  2010).

Khodzhayev's wife was expelled to Tajikistan whilst her husband was in a temporary detention facility of the Odintsovo District Department of the Interior - between 30th November 2007 and 30th January 2008 (European Court of Human Rights, 2010).
